REFORMING THE GOVERNMENT OF THE EXECUTIVE BRANCH

This is the last segment of the Government of the Executive Branch series. It focuses on potential reforms to address the issues spelled out in the first sixteen segments of the series. The contents include:

We are witnessing some reforms to the Administrative State by the Trump Administration to date, including:
  • Elimination of DEI (Diversity, Equity, and Inclusion) training and ideology throughout the administrative state thus deterring cultural Marxism infiltration.
  • Doge activity uncovering waste and fraud plus revamping the Education Department, the overhaul of FEMA, and directives to kill old weapons production and speed up new weapons into the field by the DoD.
  • The merging of USAID into the State Department with efforts to increase effectiveness
  • The downsizing and reconstitution of the Office of Net Assessments.
  • Significant changes in leadership and policies in Homeland Security by Christy Noem, in the Department of Justice (including the FBI) by Secretary Bondi, and CDC and FDA leadership and policies by Secretary Kennedy.

THE ADMINISTRATIVE STATE PROBLEM

The consequence of bureaucratization has been an increased tension between the executive and the legislative, regardless of party, and increasing apathy among voters. This is so because most important political decisions are made in Washington by a centralized administration not accountable to the elected chief executive. Moreover, the interest of the legislature is closely allied with – and committed to the perpetuation of – an executive bureaucracy. Thus, the bureaucracy, ostensibly nonpartisan, will retain effective power when backed by Congress.

By the end of the 20th century, it appeared to be the case that American politics could no longer be structured by the ordinary, or practical, operation of separation of powers. Rather, the actual conduct of the political branches of government was shaped by the ongoing necessity of accommodating, and ratifying, the actions of the rational, or administrative state. In other words, it was an element of government itself, the bureaucracy, which had the purpose and unity of the political branches, and with the blessings of the courts.

The growth of the administrative state has made it possible to politicize the culture by undermining the institutions of civil society, including the family, church, and nearly all private associations. That transformation was not brought about politically, but administratively, through the bureaucracy and the courts. The various nationally organized interests, whether political, economic, social, media, entertainment, educational, scientific, cultural, or religious, have accommodated themselves to centralized rule. But it is not clear that the American people are convinced that government now operates on behalf of a public good.

The necessity to preserve those administrative structures had become essential to modern government. It led many within those organizations to consider institutional loyalty as fundamental to the defense of democratic government itself. For that reason, the nonpartisan character of bureaucracy, its avowed neutrality, could be cast aside. It became a defender of the administrative state, a faction on behalf of government that could no longer be regulated by government. As a result, the bureaucracies have developed the instinct for self-preservation at all costs.

Further, the Progressive defenders of the bureaucratic state see government as the source of benevolence, the moral embodiment of the collective desire to bring about social justice as a practical reality. They believe that only mean-spirited Reactionaries can object to a government whose purpose is to bring about this good end. Defenders of the older constitutionalism, meanwhile, see the bureaucratic state as increasingly tyrannical and destructive of inalienable rights.

TOP REFORMS TO DEFEAT THE DEEP STATE

OVERALL: The Existence of the Deep State is a Treasonous Foe Unworthy of this Land.
My advice is as follows:
1. While the Deep State is a formidable cancer, and more insidious and deeply rooted today than at any time in U.S. history, it is not invincible.
2. Defeating the subversive designs of corrupt government officials has been achieved before, and much can be learned from those historical victories.
3. There is growing momentum in favor of accountability. A growing mass of informed citizens understands that the Deep State is not “Trump’s crazy talk,” but a real, existential threat to liberal democracy.
4. The Deep State can be picked apart with a targeted, surgical effort. While that cabal as a whole may now be more powerful than all three branches of the federal government combined, its individual members are weak and cowardly gangsters.
5. Their playbook is no longer a secret. The playbook reveals the Deep State’s strategic character and enduring predispositions, and it provides detailed descriptions of its tactics, techniques, and procedures. It also reveals the Deep State’s weaknesses, which can be exploited. The Deep State operates in a rote, unimaginative manner, constrained by its own rigid administrative architecture. That is the Deep State’s Achilles heel.

THE CIA & FBI – or at least their essential functions – are far from lost. But as those mid-level careerists, to whom mandatory DEI is normal if not essential, advance up the professional ladders, they recruit new people, often without regard to knowledge, talent, and aptitude, into the latest generation of careerists. At the current rate, they will take total and permanent bureaucratic control. This is normal for any self-perpetuating and politicized civil service or its equivalent. Within another full presidential administration, the American intelligence community will be recovered or lost. After that point, it will matter little who is president.

OVERALL: Aggressive Congressional Oversight: Congress must more aggressively subpoena documents and witnesses to uncover wrongdoing in every branch of government. This includes the formation of a new Church Commission, modeled after the congressional body that uncovered CIA crimes and spying operations on the civil rights movement. If the bureaucracy resists, the strategy of fencing should be more commonly used to withhold funds until agencies comply with congressional requests.

Prosecute Leakers: The Department of Justice has the forensic capabilities to discover leakers. Every single one of them should be found and prosecuted for violating the law. Additionally, government employees should be required to sign non-disclosure agreements (NDA’s) subjecting themselves to criminal prosecution for violating the requirement that already exists; that all government devices (cellphones, laptops, etc.) can be used for authorized government work only. Then, those devices should be subject to mandatory monthly scans across the entire federal government to determine who has improperly transferred classified information, including to the press.

Civil Service Reform: The next president should reinstitute Schedule F, a Trump administration policy creating a new classification for federal employees that made it easier to fire them if they subverted the president’s agenda. Additionally, Congress must change the law to allow federal bureaucrats to be able to be fired by the president.

OVERHAULING THE FBI

Things are bad. There’s no denying it. The FBI has gravely abused its power, threatening not only the rule of law, but the very foundations of self-government at the root of our democracy. But this is not the end of the story. Change is possible at the FBI and desperately needed. Enacting these reforms won’t be easy, but curbing the rise of government tyranny never is. We must always remember that no matter how much corrupt actors have twisted our government, America is ruled by the people – and we have the authority and obligation to take our country back.

It all starts with extremely aggressive congressional oversight. The FBI must be brought back under the control, direction, and accountability of elected officials and have its vast power curtailed. Congress has a vital role to play. They must liberally exercise their subpoena power to expose every single bit of filth and corruption at the FBI and DOJ.  The agents and lawyers who think they can hide in the shadows while abusing their positions will be put on immediate notice. If they do wrong, they will be exposed, they will be dragged before Congress. And the American public will know exactly who they are. The next president must fire the top ranks of the FBI. Then, all those who manipulated evidence, hid exculpatory information, or in any way abused their authority for political ends must be prosecuted to the fullest extent of the law. The only way to stop corruption is to make it abundantly clear that corruption has consequences.

Of course, the Deep State’s allies in the Democrat Party and the fake news mafia will not go quietly. They will claim we are endangering national security, undermining the integrity of federal law enforcement, and politicizing the DOJ and the FBI. This is the strategy that used to work, but not anymore. The Deep State will leak embarrassing information. They will start fraudulent investigations. They will try to hide their activities with false labels of classification. We know their playbook, and we shouldn’t believe their lies. When they come at us, we must hit them back harder, calling them out for the grave damage they have done to our nation, all for the glorification of their massive egos.

The FBI needs structural reforms as well. It has become so thoroughly compromised that it will remain a threat to the people unless drastic measures are taken. Most importantly, we need to get the FBI the hell out of Washington, D.C. There is no reason for the nation’s law enforcement agency to be centralized in the swamp. Keeping the FBI in the behemoth Washington HQ building only allows for institutional capture and incentivizes senior leadership in the FBI to lose focus on their mission and learn how to play political games instead, currying favor with politicians and cultivating relationships with the press to advance their career. Ambitious FBI agents are forced to swim in this environment. Right now, every agent is taught in field offices across the country that if you want to rise through the ranks, then you have to do a tour in Washington.

The FBI and DOJ should also be banned from jurisdiction shopping, and policies should be instituted to ensure truly blind jurisdiction choices. Judge shopping has led to grossly political outcomes that undermine faith in our institutions and make a mockery of the idea of equality under the law. Congressional and presidential oversight must hold the FBI to its true purpose by using the budgeting purse strings to demand obedience to the oath of office every agent takes. We know who the bad actors are. We must rein them in. There is a reason two separate agencies exist – one to investigate, another to prosecute. That’s because prosecutors should only prosecute real crimes, not find evidence for “crimes” they want to prosecute. That line has all been blurred, and cowardly leadership in the DOJ has genuflected to the whims of the FBI brass while they manipulate the DOJ’s core mission. This has led to costly failures and destruction of the chain of command in law enforcement. Remember, the FBI reports to the DOJ, not the other way around.

Cut the General Counsel Office: Instead of operating as a purely investigatory body, the General Counsel office within the FBI has taken on prosecutorial decision-making. In effect, they are centralizing power to both investigate and prosecute crimes, even though it is the job of DOJ alone. The General Counsel office should be significantly reduced in size.

The FBI cannot survive in its dual roles as a law enforcement agency and a domestic intelligence service. The ethics of an intelligence agency is different from a law enforcement agency. In a traditional law enforcement agency, agents live every day for the time to come when they get on the witness stand and say nothing but the truth. But an intelligence agency deals with lies and disruption. It’s a whole different mindset between the two.

WHAT TO DO WITH THE CIA

The CIA has run its course and should be dissolved in favor of something new. To start with, the organization should be split in two: a new intelligence service responsible for the collection and analysis of intelligence, and a separate service responsible for covert operations abroad. Those services should be small and efficient, and free from woke critical theory, people who contaminate the professionalism of intelligence. This takes leadership.

Without a grand strategy to shape America’s role in the world, to defend effectively against foreign adversaries and enemies, the U.S. has no means of deciding what kind of intelligence community it needs, how it should be configured, how its people should be recruited and trained, how its duties should be tasked, and how it should be budgeted.  This lack of American strategic consensus limits a convincing “what to do” plan. The strategy should be to cull the agency of anyone involved in the clown show the agency has become before any employee can be considered for transfer to either of the two proposed and smaller intelligence services. Any office, position, program, contractor, or official responsible for pushing critical theory must go. A new intelligence leadership will need to pull a lot of bureaucratic tricks to cull the deadwood and toxins from the agency.

Intelligence collectors and analysts must be forced to do a better job through harder professional competition, and this means cutting their budgets and positions to weed out all but the most talented, creative, and courageous. Every single member of the intelligence community who illegally leaks classified information should be investigated, arrested, and prosecuted. Enforcement of secrecy laws is seldom employed against those who leak to the media for personal or policy reasons, even though such leaks cost the American taxpayer billions of dollars. Leaks allow anonymous intelligence agencies or personnel to contaminate the American news media and therefore public sentiment and debate, constituting threats to the integrity of citizens’ political opinions and to the nation’s democratic and legal processes. Impartial enforcement of existing law will go a long way toward reducing the abuse of secret intelligence for political purposes.

And the CIA should not be in the business of using intelligence resources on issues like the environment and climate change. Thus, the CIA, or rather its successor agencies, can eliminate thousands more personnel from its roles. A president must repeal all the Obama and Biden executive orders that mandated critical theory and cultural Marxism, under whatever names. He must issue executive orders to abolish all intelligence professional and contractor positions that administer, promote, or enforce critical theory and cultural Marxism. Those individuals must not be administratively transferred to other positions. Without another position to go to they will be compelled to leave the intelligence service. Their security clearances must be revoked so that they can never work in the classified world. Cultural Marxism must be added as another deal-breaker for recruitment of prospective intelligence professionals. Likewise, the intelligence community should disaccredit colleges and universities that act as feeder schools if those institutions deliberately cultivate prospective intelligence professionals in cultural Marxism. As for the FBI, all that applies and more.

Create a Permanent Declassification Office: The next president should erect a permanent office within the Office of the Director of National Intelligence (ODNI) that continuously reviews classified material that should be declassified, in whole or in part, for the public interest. This office should report directly to the president.

Cut the Size of the Intel Community: The number of staff at ODNI and throughout the intelligence community, including the CIA and the NSA, must be drastically reduced to eliminate duplicative offices and cut down on information silos and the practice of stove-piping – where intelligence officials funnel important information directly up to the agency heads without sharing it with others. Intelligence agencies must be refocused on ground-level intelligence gathering.

REFORMING THE DEPARTMENT OF JUSTICE (DOJ)

The problem isn’t that we have a Department of Justice. The biggest problem is that the law is being selectively applied. When it comes to political allies, left-wing radicals at the DOJ play with kid gloves, refusing to prosecute or even proactively trying to absolve their friends of crimes. Yet their political opponents are prosecuted and harassed to the greatest extent of the law – even when they’ve done nothing wrong. The DOJ desperately needs comprehensive housecleaning, and that starts at the top. First, we need an attorney general who will take on his own staff and put an end to abuses of prosecutorial discretion. Laws should be applied fairly and equally to all. Right now, they are applied selectively based heavily on politics.  

This is an easy change to make. All it requires is the attorney general modifying the Justice Manual – the guidebook that all federal prosecutors must follow. Any attorney general can change these absurd rules, but none have because they don’t want to undermine the institution by changing tradition – a farcical excuse in an institution with rapidly diminishing credibility. As a result of these fears the DOJ hasn’t made any major changes to these rules since Eric Holder was in office under President Obama; this despite the fact that gross abuses and misconduct have been uncovered during and since that time. A final reform that would vastly improve the operations of the DOJ would be to drastically curb the practice of prosecuting trials within the District of Columbia.

The Department of Justice is not beyond reform. Perhaps more than any other corrupt federal bureaucracy in the Deep State, the DOJ can be fixed through a strong attorney general and tough lieutenants who are willing to take on the swamp and implement these reforms. Fixing the DOJ is our only hope to reestablish equal justice under the law in America.

Fixing FISA: Thankfully, the FISA Court, too, can be reformed. This starts with FISA Court judges themselves. Currently, the chief justice of the Supreme Court chooses judges to serve on the FISA Court for short, one-month terms in rotation. That means every month a new judge walks in who has no background on the cases before them and sometimes little to no knowledge of national security or counterterrorism law. When these judges lack the requisite background knowledge, they are at the mercy of the FBI or whatever other prosecutor is there pushing for a warrant, since those are the only people in the room who have knowledge of the case. As a result, the vast majority (often over 99%) of warrants are approved with a literal rubber stamp. Most stunningly, there is no court reporter at the FISC. Unlike what you see in every single criminal and civil proceedings in every single court across this country, at FISC there is nobody typing away as those in the court speak, immediately putting to paper every word uttered. Without that record, nobody knows what was said during FISC proceedings. This must change overnight. This is the destruction of due process. Requiring a court reporter in the FISA Court may be the single most important and easiest of reforms suggested in these pages.
 
DEPARTMENT OF DEFENSE REFORMS

Reestablish Civilian Control of the Military: Politicized, ineffective officers must be immediately fired by the next president. At the same time, the next administration should end the process whereby the chairman of the Joint Chiefs of Staff effectively chooses flag officers. Promotions at the highest levels of the military should be done on merit and solely upon the discretion of the president and the secretary of defense.

Fix the Procurement Process: The current procurement process is not only wasteful, it operates as a blood money scheme where high-level Pentagon employees continue bad programs and pursue foolish engagements abroad to enrich their future employers within the defense industry, or the Defense Industrial Complex. The next president must appoint a secretary of defense and undersecretaries of R&D who refuse to rubber-stamp wasteful projects. Congress must restrict budgeting to cut waste in procurement as well. Lastly, laws and/or regulations must be implemented that ban employees within the Defense Industrial Complex from being hired at the Pentagon and to restrict Pentagon employees from later working within the Defense Industrial Complex.

SOME PROPOSALS FOR HEALTH AND HUMAN SERVICES REFORMS

  • Regulators must be freed from drug company funding. This includes the FDA funding which must come directly from the government, as opposed to pharma fees, as is now the case. Tying employee salaries to pharma fees creates a huge conflict of interest within the FDA.
  • The revolving door between regulators like the FDA, CDC, and Big Pharma (as well as tech/media) must stop. Employment contracts for regulatory government positions must have “non-compete” clauses whereby employment opportunities are limited upon leaving these regulatory agencies. Likewise, Big Pharma executives should not fill positions at regulatory agencies.
  • The government and its employees have a moral obligation to the public to conduct clinical trials in ways that are not biased by industry,
  • The Foundation for the CDC and the Foundation for the NIH, which run clinical trials and studies for their respective organizations (while their boards are made up of pharma industry executives and employees) must be decommissioned.
  • Off-label drugs must continue to be used by the medical community. The early treatment protocols, which have saved countless lives, have documented the important role that physicians have played in finding cheap and effective treatments for COVID as well as many other diseases. Let doctors be doctors.
  • Scientific and medical journals must be stopped from taking monies from Big Pharma. This includes the sales of reprints, banner ads, print ads, etc.
  • Government must stop interfering with the publishing of peer reviewed papers and social media. A free press must remain free from coercion from government.
  • Informed consent, one of the foundations of modern medicine, has been stymied by the FDA, NIH, and CDC hospitalists, Big Tech and social media. They have been hiding data and skewing results. When people cannot get the information they need to make informed decisions, evidence-based medicine cannot function correctly.
  • Pharmaceutical companies and biotech should not be able to advertise their drugs and medical devices. Either the FDA or Congress needs to act to close this loophole.
If we are to ever trust and support the concept of evidence-based medicine again, significant changes to the system must be enacted. This only question is … are our government and our HHS bureaucrats up to the job?
