 WHAT IS HAPPENING TO OUR COUNTRY: SEGMENT 4

Dear Friends and Family,

This segment points out six significant criminal justice trends that are negatively impacting the rule of law in our country.
  1. Escalation of public crime because of defunding police and rogue prosecutor actions.
  2. Government use of the criminal justice system to criminalize protests against school curriculum, government mandates, and specific political party policies.
  3. Government not upholding the law, e.g. Supreme Court Justice safety, the border, and not abiding by Supreme Court ruling – student loans.
  4. Government executive branch emphasis on making new classification of crimes for their political benefit, e.g., the crime of white supremacy.
  5. Weaponization of the government against a political opponent, e.g., actions taken against Donald J. Trump.
  6. Executive branch creating false evidence, e.g., the Russian dossier and Hunter Biden’s laptop.
Analyzing these six points as a collective is what led me to my rating going forward of “Significant Alarm.” Each point by itself undermines the rule of law in the direction of totalitarianism. Lumping them together indicates a very alarming trend.

 WHAT IS HAPPENING TO OUR COUNTRY AT PARTY – SEGMENT 4
CRIMINAL JUSTICE – EXCERPT

CRIME AGAINST THE PUBLIC: Today’s Democrat party has the stunning ability to ignore the possibility that radical action will produce any negative outcomes. Let’s empty all the jails while simultaneously getting rid of the police! Surely all of society will operate in peace and goodwill. Wrong!!!  The crime wave of recent years has been epic, shoving the country back toward the 1970s. Cities gave up almost overnight the decades of progress they’d made with the broken-window approach, and entire neighborhoods sank back into squalor. Progressive prosecutors’ refusal to prosecute “victimless crimes” turned portions of major cities into homeless encampments, rife with drug use, graffiti, crime, sanitation issues, and mental health problems. Urban businesses face a new onslaught of brazen thievery and “smash and grab” robberies. The U. S. in 2020 saw its biggest growth in homicides since national records started in 1960 – 29%. CNN reported that more than two-thirds of the nation’s forty most populous cities experienced more homicides in 2021 than in 2020, while at least ten registered all-time highs.

One obvious problem: fewer cops to dissuade the criminals. The “defund the police” movement pushed cities into cutting police budgets. Police also began retiring from or quitting major urban forces – sick of ambush attacks, political abuse, and bail reform. The New York Times in June 2021 reported that in the twelve-month period ending in April of that year, police retirements nationwide were up 45%, and resignations 18%. It is African Americans and Hispanics who most suffer when police numbers fall and crime soars, as the lawbreaking happens more frequently in neighborhoods where they live. The federal government does not exercise general police powers. That is the exclusive remit of state and local governments, and nearly all the crime Americans care about fall into that category.

And in the November 2022 election, Democratic governors and mayors found themselves on defense of crime nationwide. It wasn’t just their own handling of the issue that hurt them. Biden, by initially allying with antipolice crusaders, has branded the entire party. The electorate has faced a crime outbreak unlike anything in decades and voters are having no problem recalling who launched it – progressive prosecutors and liberal politicians. Biden inherited a country that had figured out how to keep crime low, then proceeded to help trash the reforms and progress, plunging the nation back into disorder.

Democrat mayors, who run nearly every major city in the country, eschew a tough-on-crime approach because it’s politically unpopular among left-wing voters. Even President Trump, who tweeted critically of the Black Lives Matter riots of 2020, stopped short of cracking down on the uprisings himself. Joe Biden rose through the political ranks as being tough on crime, as did his vice president, Kamala Harris. Yet Biden has avoided the issue almost entirely as president. Politically, it is probably the smart approach. Taking the challenge of our deteriorating cities head-on would be tantamount to an admission that Democrats have failed their own constituencies. The Left often tries to deny this point, but our urban centers are getting more crime ridden as they get more expensive, and they are run by Democrats. If Biden confronts this, it is a tacit attack on his political allies and his own voter base. After all, Democrats or unaffiliated liberals are in charge of twenty-two of the twenty-five biggest cities in the country.

Kamala Harris’s Confused Messaging: At the beginning of her primary campaign for president, Kamala Harris touted her career as a prosecutor and attorney general of California as a qualification for president. She called herself a “top cop.” When the political winds began to change in the summer of 2020 and cops fell in disfavor with Progressives, Harris tried to reinvent herself as a criminal justice reformer and an ally of Black Lives Matter. Messaging her message has always been a challenge for Harris. In an effort to straddle the fence between “soft on crime” and “tough on crime,” she has tried to persuade voters that she is “smart on crime.” What she has most often been, however, is confused on crime – and on police reform. The problem with Kamala Harris is not her position regarding defunding the police. The real problem is that she won’t take positions or answer questions. Trying to get a straight answer is like trying to nail Jell-O to the wall. She has no core convictions – and that’s a dangerous quality for a leader.

ROGUE PROSECUTORS and the RISE IN CRIME: Approximately 90% of criminal cases in the U.S. are handled by the 2,300 district attorneys spread across 3,143 counties. Until recently, elected county district attorneys upheld their end of the social contract by firmly and fairly enforcing state criminal laws and protecting citizen’s rights. Over the last 30 years, they played a critical role in driving down crime rates, while at the same time creating thousands of alternatives to incarceration, such as drug courts, domestic violence courts, mental health courts, and other successful programs.

That changed in 2013 with the launching of the George Soros-funded “progressive prosecutor” movement.  This movement is animated by two beliefs. The first is that the entire criminal justice system is systemically racist. The second is that the only way to fix the system is to dismantle it by replacing law-and-order district attorneys with pro-criminal and anti-police district attorneys. The sick irony of this movement is that in the areas where it has prevailed, the most harm has been done to the racial minorities whose interests it purports to represent.

From the start, the movement focused on the fact that prosecutors, not police, are the gatekeepers of the criminal justice system. District attorneys decide whether to file charges and which charges to file. By replacing traditional prosecutors with attorneys who see defendants as victims, it would be possible to ‘reverse-engineer” and “dismantle” the existing criminal justice system. One of the hallmarks of the rogue prosecutor movement has been its usurpation of the constitutional role of state legislatures. Once elected, rogue prosecutors refuse to prosecute entire categories of crimes that are on the books in their states, justifying their refusal by claiming “prosecutorial discretion.” But in fact, their refusal to prosecute crimes violates the separation of powers between the executive and legislative branches of government and distorts the entire legal system. By refusing to prosecute entire categories of crime, they are in effect repealing criminal statutes – acting in place of the legislature. This is prosecutorial nullification, not discretion. Today, there are more than 70 rogue prosecutors across the country.

One of the most pernicious policies to come out or the rogue prosecutor movement is the refusal to ask for cash bail, which represents a guarantee by a defendant (or by a person acting on behalf of a defendant) that the defendant will show up for trial.

Predictable Results: Crime rates have exploded in the cities that have elected rogue prosecutors. In Chicago, in the six years before Kim Foxx became the state’s attorney for Cook County in 2017, there was an average of 310 homicides per year. That number rose to 660 in her first year, and through 2022 it averaged 666 per year – with over 75% of the victims being black. To put this carnage into perspective, between 2003 and 2010, there were 3,481 Americans killed in action in Iraq, and average of 435 per year. In the war in Afghanistan, between 2001 and 2014, there were 1,833 Americans killed in action, and average of 141 per year. Chicago’s annual murder rate dwarfs these figures. It is not an exaggeration to say that parts of Chicago, on any given weekend, have become domestic war zones.

CRIME AGAINST ANTI-WOKE CITIZENS: Upon confirmation Attorney General Garland seemed to shift the focus of the Department of Justice (DOJ) to systemic discrimination and the supposed crimes of the anti-woke. In 2021, protests against mandates, critical race theory being taught in classrooms, and woke transgendered policies in schools swept the country. Met with resistance from parents, educators pushed back on those pesky moms and dads who wanted a larger say in their children’s education. The National School Boards Association (NSBA) sent a letter to Joe Biden asking for law enforcement to intervene after “threats and acts of violence” endangered school board members. Shortly after the letter was received, Garland sent a memo to the FBI calling on the Bureau to help local law enforcement stop the (supposed) violence. Yes, our government was actually considering whether these concerned parents might have been terrorists.

POLITICAL MOTIVATED CRIMES: Following the leak of Justice Samuel Alito’s draft majority opinion in the Dobbs v. Jackson Women’s Health Organization case, which foreshadowed the overturning of Roe vs. Wade, America endured a “Summer of Rage.” The Family Research Council documented more than one hundred acts of violence, destruction and harassment aimed at intimidating anti-abortion Christians and conservatives. These attacks generated no meaningful response from Garland or anyone else in federal law enforcement.

A radical pro-abortion group, organized protests at the homes of the “six Catholics” on the Supreme Court (Justices Roberts, Alito, Thomas, Kavanaugh, Barrett and Gorsech. The group also encouraged followers to demonstrate “at or in a local Catholic Church.” About a month after the draft opinion leaked, a man threatened to assassinate Justice Kavanaugh, showing up at his house with a gun, a knife, and zip-ties. He was arrested. Yet these real acts of violence and intimidation apparently did not make Garland’s priorities list. He had deeper concerns, like January 6th. Garland pulled personnel from other investigations to concentrate on the Capitol Riot of 2021. The FBI even sought out the public to snitch on their fellow citizens if they recognized anyone in public footage who entered the Capitol. Sixteen protestors got arrested and held in jails with reportedly deplorable conditions, often for months at a time without bail – and zero outrage from purported social justice activists.

These are the priorities of Biden’s top cops. They are managing our decline. Innocents and political rivals are targeted while criminals run free. This is our new Joe Biden America.

THE CRIME OF WHITE SUPREMACY: Never mind seizures of deadly fentanyl from Mexico up 311% between March 2020 and March 2022, human traffickers earning up to $14 million a day to smuggle people across the southern border, and billions of dollars of taxpayer funded border wall parts and pieces deteriorating in the desert sun. Forget the Antifa thugs in Seattle and Portland physically attacking conservative protesters and threatening to “dismember” reporter Andy Ngo, or the Trump-hating leftist who plowed into a Waukesha, Wisconsin parade and killed six people. Secretary of Homeland Security Alejandro Mayorkas doesn’t seem to be counting any of this as domestic terrorism.

The real problem Mayorkas wants to solve is “right-wing” white supremacy.  

Secretary Mayorkas, who is responsible for border security, airport security, and cybersecurity, in an April 2022 speech made his singular priority clear: “the greatest terrorism that we face in the homeland is the threat of domestic violent extremism.” Mayorkas went even further, saying “the most prominent threat is the threat of White supremacists.” President Joe Biden said that “white supremacy” is terrorism and is the “most lethal threat to the homeland today.”

One problem. It simply isn’t true. The basis for this claim appears to be a March 2021 intelligence community assessment that does indeed point to an “elevated threat” from domestic violent extremists. But that assessment refers to extremists of all stripes, including Islamic extremists, Antifa, lone-wolf mass shooters, and other domestic terrorist who have no connection to right-wing politics.  

When the House Judiciary Committee Republicans released their thousand-page report documenting the politicization of the FBI, a string of credible whistleblowers confirmed many of our worst fears. The FBI inflated and manipulated statistics on domestic terror for political purposes. Multiple FBI sources from a variety of offices confirmed to House Republicans that they had been pressured to find more cases of domestic extremism.  Current and former FBI agents expressed frustration to the Washington Times with the administration’s white supremacy obsession.

CRIMINALIZING DISSENT: On February 7, 2022, two weeks before Russia invaded Ukraine – potentially igniting a third world war – the Department of Homeland Security (DHS) issued a National Terrorism Advisory System Bulletin announcing a heightened threat environment. Not because of the coming conflict with a nuclear superpower, the very real likelihood of energy and food shortages, or the possibility of enemies crossing our borders during wartime. No. This important bulletin warned against speech and wrongthink by people who disagree with the administration. In other words, anyone who questioned the result of elections in 2020 or who has grievances with the way our government addressed COVID-19 is listening to align foreign actors who are trying to damage America, and thus is connected with terrorism.

The very possibility that government could be tracking which voters support the current administration and which ones would likely oppose it provides an irresistible temptation for the puppet masters hoping to retain their power. The opportunities for abuse are endless. Government could reward and punish – targeting and harassing political opponents while looking the other way in matters involving loyal partisans. It could target specific voters with ostensibly nonpartisan get-out-the-vote activities. Indeed, many allege these things are already happening. In a May 2016 report, the Government Accountability Office found the database contained over 411 million people, only about 30 million of whom were “criminal and civil mugshots.”

Facial recognition databases have since been used to identify suspects who participated in the January 6, 2021, protest at the U.S. Capitol and to find people who participated in the 2020 Black Lives Matter protests following the murder of George Floyd.

WEAPONIZING THE GOVERNMENT AGAINST A POLITICAL OPPONENT: While he was president, Trump was subjected to a multiyear, multimillion-dollar federal investigation based on Democrat Party and media accusations, ginned up by unethical and even illegal activity by senior FBI, Department of Justice (DOJ), and intelligence officials, that he and his 2016 campaign colluded with the Russian government to win his election. A so-called Russian dossier, which was funded by the Hillary Clinton campaign and was a complete fiction, served as the launching-off point for the Democrat Party, media, and FBI allegations against Trump. The former FBI director James Comey, despite knowing that the dossier was false, used it to threaten Trump when he was president-elect and in the earliest days of his administration. The Washington D.C. mob grew louder and louder, demanding the appointment of a special counsel to investigate a Hillary Clinton-Democrat Party-FBI-concocted fiction scandal against Trump. The deputy attorney general, Rod Rosenstein, buckled to the Democrat Party pressure and appointed Robert Mueller as special counsel to investigate the matter. Mueller concluded that there was no collusion between the Russians and Trump or his campaign.

More recently, after his own four-year investigation, Special Counsel John Durham, a longtime career federal prosecutor concluded that there were myriad acts of misconduct by the FBI and DOJ senior officials who were plotting and scheming to take down Trump. Durham determined that the FBI and Justice Department jumped to investigate former President Trump’s campaign despite a lack of sound evidence, a ‘notable departure’ from the way it resisted efforts to investigate Hillary Clinton’s campaign. “The speed and manner in which the FBI opened and investigated Crossfire Hurricane during the presidential election season based on raw, unanalyzed, and uncorroborated intelligence also reflected a noticeable departure.”

Durham further reported, that “then President Barack Obama and then-Vice President Joe Biden were personally briefed by then-CIA Director John Brennan in 2016 that the CIA had evidence of Hillary Clinton planning to falsely link then-presidential candidate Donald Trump to Russia …” Thus, both Obama and Biden, as well as Attorney General Loretta Lynch, CIA Director John Brennan, FBI director James Comey, and   of course Hillary Clinton knew that the entire Russia collusion matter, and the federal investigation undertaken by the FBI and DOJ, was based on a horrendous lie and dirty trick unleashed by Hillary Clinton and the Democrat Party. In other words, the entire hierarchy of the Obama administration knew what was going down, and knew it was, in effect, a coup.

The Espionage Act of 1917 was used to intimidate and silence any opposition to President Woodrow Wilson. A hundred years later, another Democrat president – Biden – and his DOJ dusted off the Espionage Act and used it against another political opponent, Donald Trump, whom he like Wilson, seeks to imprison. Trump has now been indicted by special counsel Jack Smith on thirty-seven counts, thirty-one of which relate to the Espionage Act of 1917. These thirty-one counts are what lawyers call “piling’ multiple charges against the defendant, even though they spring from the same or similar alleged events. It is a sleazy practice. There is a reason the Espionage Act has never been used against any former president or vice-president – it was never intended to be use against a president or vice president.
Professor Alan Dershowitz, writing in Newsweek, in a column titled “The Most Dangerous Indictment in History,” makes the point that this is a momentous occasion, and not only for President Trump. This moment portents a massive change to the norms of this nation that all Americans who care about the neutral rule of law should pay attention to, for it raises the specter of the partisan weaponization of the criminal justice system.”

The Democrat Party does not care about what it is doing to our country, the system of justice, and our electoral process. It is the state party, seeking to monopolize our politics, society, and culture. This is a revolution. The party comes first. The Democrat Party has abandoned comity and civility for character assassination and the iron fist, a fact that establishment Republicans have difficulty grasping. It has joined a long list of political parties around the world, past and present, that are totalitarian in nature and do not tolerate democracy, fair elections, and equal justice before the law.

Fifty-one former high-level intelligence officials manufactured “a Russian disinformation” out of thin air to keep voters from seeing damning information on Hunter Biden’s laptop that could have implicated Joe Biden just weeks before the 2020 election. Biden’s campaign knew that if voters saw what was on Hunter Biden’s laptop, it might cause voters to think twice before voting for Biden. Unwilling to take that risk, current secretary of state Antony Blinken, then a senior Biden campaign official, reached out to former acting CIA director Mike Morell and asked him to “help Biden” by enlisting his former colleagues in the intelligence community to sign a letter warning the American people that the Hunter Biden laptop “has all the classic earmarks of a Russian information operation.” There was no evidence of this, and they knew it.

President Biden used this letter as his “evidence” a few days later during an October 22 presidential debate against Donald Trump. As planned, he immediately dismissed Trump’s accusations that he and his family were profiting from peddling influence in foreign countries. Biden flippantly said it was all just “a Russian plant” and pointed to this manufactured letter by “fifty former national intelligence folks” as proof. It worked. The letter made headlines. It was repeated over and over by propaganda media. To this day, not a single person involved in this lie has apologized or been held accountable.
